Rights
No matter where you are or what your legal status is, you have fundamental human rights. These are established by international law.
Best Interests of the Child
According to Article 3 of the UN CRC, in all actions concerning children (anyone under 18), your best interests must be a primary consideration. This applies to courts, welfare systems, and immigration authorities.
Right to Be Heard
Article 12 guarantees you the right to express your views freely in all matters affecting you, and your views must be given due weight according to your age and maturity.
Protection and Care
Article 20 states that if you are deprived of a family environment, you are entitled to special protection and assistance provided by the State.
Refugee Children
Article 22 specifically ensures that a child seeking refugee status, whether unaccompanied or not, receives appropriate protection and humanitarian assistance.
You have the right to understand what is happening to you and to be heard in decisions about your life (UN CRC Article 12).
- In many countries, an unaccompanied minor is given a guardian or representative to act in your best interests.
- Many places provide free or low-cost legal help for minors and asylum-seekers. Ask for it early.
- You can ask for an interpreter in a language you understand.
- You do not have to sign or agree to anything you do not understand. You can say: “I don't understand. I want a lawyer / an interpreter.”
This is a right, not a favor — but how it works depends on the country, your age, and your situation.
Non-Refoulement
This is the core principle of international refugee law. It means a country cannot return you to a territory where your life or freedom would be threatened.
As a young person, you can claim asylum in your own right. You do not need to be an adult to be recognized as a refugee.
